Complete Independence
In the event of a dispute, arbitration can offer a fast and effective solution. An arbitration agreement is needed for this. This could be incorporated in a clause in a contract, whereby future disputes would be referred to arbitration. For this purpose, the Netherlands Arbitration Institute has drawn up a recommended clause. This clause is worded so as to avoid as many problems as possible.
As an independent foundation, the NAI will itself take on the role of Administrator. The arbitrators appointed by the NAI, in consultation with the parties involved, must be absolutely impartial and completely independent.
If there is no arbitration clause, an arbitration agreement can also take the form of a compromis (submission agreement) for existing disputes.
