Advantages

The main advantages to be gained from the incorporation of the NAI arbitration clause in an agreement are that:

• arbitration has already been agreed before any dispute arises
• arbitration will be conducted in a manner acceptable to both parties (place of arbitration, language, composition of tribunal, etc.)
• arbitration will be confindential and will not be made public
• a decision will often be rendered more quickly than in a court hearing, where manoeuvring plays a (more) important role
• it will often be the case that both parties carry on doing business together while the arbitration is being conducted
