Costs

It is difficult to give an estimate of the costs in advance. The total cost of an arbitration is made up of the following elements:

Fees of the arbitrator(s): based on time, the amount in dispute and the complexity of the case and expressed as an hourly rate. This hourly rate is agreed by the NAI with the arbitrators upon appointment on the basis of established guidelines drawn up by the Governing Board.

NAI administration costs: calculated on the basis of a scale which ranges from EUR150 (amount in dispute less than EUR5000) to a maximum of EUR10000 (amount in dispute greater than EUR2,000,000). The costs of a secretary or clerk, expert and/or interpreter will sometimes be added to this. Finally, there may be costs for legal assistance. Compulsory legal representation will not apply.
