Specific Clause and Compromis (submission agreement)

In most cases, the incorporation of the standard NAI arbitration clause in contracts will suffice. Practice has shown that the NAI clause is worded so as to avoid as many problems as possible.

It is not inconceivable, however, that there may be circumstances which require the formulation of a specific arbitration clause. In such cases, the NAI will provide advice in respect of drafting the clause.

If parties have not included an arbitration clause in a contract, they may still submit disputes arising between them to NAI arbitration by concluding a compromis (submission agreement).
