Can the NAI disclose an arbitral award in respect of a particular case?


Arbitral decisions rendered under the auspices of the NAI will not be disclosed to third parties, as confidentiality is considered to be one of the benefits of arbitration.

However, a number of arbitral decisions are published anonymously in the publications ‘Tijdschrift voor Arbitrage’ and ‘Bouwrecht’. Parties are free to register their objections.
