Place and language of arbitration
It is possible to establish the place and language of arbitration in an arbitration clause.
The choice of the place of arbitration in particular is extremely important. This is because the place of arbitration determines which procedural law will apply to the arbitration. The oral proceedings, on the other hand, may take place anywhere.
If, for instance, Amsterdam is chosen as the place of arbitration, the arbitration will be subject to Dutch procedural law. The oral proceedings can then take place elsewhere in the Netherlands or even in another country.
