Summary Arbitral Proceedings and Emergency Arbitration

The NAI has no special arrangements for emergency arbitration, in other words an urgent decision in respect of the dispute.

It is possible, however, to speed up the process by bringing forward certain deadlines or by omitting certain steps in the procedure. This can be set out in the arbitration clause or be agreed once a dispute has arisen.

The NAI also has what are known as summary arbitral proceedings, similar to the interim injunction proceedings of the courts. These result in interim measures and not, therefore, in a definitive judgement on the merits.
