Minitrial agreement
The minitrial agreement can be incorporated as a standard part of a business contract. Minitrial can also be agreed to if a dispute arises in cases where no minitrial clause had originally been incorporated in the contract.
In both cases, it is advisable to make arrangements in case the minitrial does not result in a decision of the dispute, for example by including an arbitration clause after the minitrial agreement.
